**May 7, 2026 follow-up** met with Mr. Garcia at careerlink. We looked at his portal and it is confusing what's happening, since he was paid after he paid off his OVP balance (plus tax offsets) and now he's suddenly having penalty weeks. He was told by someone at UC that this was from 2017 (the same year as the OVP) and that he served some weeks on a previous claim, but I couldn't figure out where or when. It appears (unless i'm reading it wrong) that he has 8 left to serve. Told him it's likely Aaron will need to reach out to the department for more information and then will get in touch with him. Advised to keep filing even though it seems like it'll still go to PWs. **Initial Note:** weird penalty week situation that Lina messaged the unit about from CareerLink. This is what she said "okay another weird situation (that hopefully applicant is not a conflict): claimant was assessed a fault OVP in 2017, paid down the whole overpayment, but just filed a new claim recently and isn't get paid because he has to serve penalty weeks. what's weird about this is claimant has filed multiple times since 2017 (2020 claim - though only for a few weeks - and a 2023 claim). On the 2023 claim, the FIRST (not last) 8 weeks of filings did not get paid out and "maximum benefit exhaustion" was the reason. Which makes no sense since these were the first 8 weeks of the claim. Claimant advocate said they didn't know what happened but yeah those were not served as penalty weeks." If that is actually the case, I think we need to argue to the SC that those weeks should count as penalty weeks and offset the remaining ones he has.
